Event Organiser Terms & Conditions

1. Introduction

Welcome to MYHitch Pass, a digital event listing and ticketing platform operated by MYHitch Australia. These Terms & Conditions (“Terms”) apply to all event organisers (“Organiser”, “you”, “your”) who list, promote, or sell tickets for events using our platform.

By creating an organiser account or submitting an event, you agree to be bound by these Terms.

2. Platform Role

MYHitch Pass provides tools for organisers to create, promote, and sell tickets to events. We are a digital platform provider only. We do not:

• host, run, or manage events
• provide event staffing or equipment
• act as the merchant or seller of tickets
• guarantee event quality, attendance, or outcomes

All obligations relating to the event and ticket sales are the sole responsibility of the Organiser. Ticket sale contracts exist strictly between the Organiser and the attendee.

3. Organiser Responsibilities

Event Delivery

• Run events safely and professionally.
• Provide entry to all valid ticket holders.
• Ensure the event occurs as advertised.

Accuracy of Information

You must ensure all event details provided are:

• accurate
• up to date
• not misleading
• compliant with Australian law

Legal Compliance

• obtain all required permits, approvals, licences, and insurance
• follow venue rules and local laws
• meet safety and accessibility requirements
• comply with Australian Consumer Law

Customer Service

You must respond to attendees regarding:

• event-related enquiries
• cancellations or changes
• refund requests
• safety concerns

MYHitch Pass does not provide customer service on your behalf for event issues.

4. Ticket Sales and Payments

You may set your own ticket prices and capacities.

All payments are processed through MYHitch Pass's secure payment system. Platform and transaction fees apply.

Payouts are made to your nominated bank account as shown in your organiser dashboard. MYHitch Pass may delay payouts for:

• fraud prevention
• chargebacks
• unresolved disputes
• cancelled or high-risk events

The Organiser is financially liable for all refunds, chargebacks, reversals, and disputes.

5. Refunds, Cancellations, and Event Changes

If an event is cancelled, postponed, or materially changed, the Organiser must:

• notify ticket holders and MYHitch Pass immediately
• provide clear instructions regarding next steps
• honour refunds required under Australian Consumer Law

MYHitch Pass may issue refunds on your behalf if:

• required by law
• mandated by the payment processor
• the organiser is unresponsive

Any refunded amounts will be deducted from future payouts or invoiced to the Organiser. Disputes relating to the event experience must be resolved directly between the Organiser and the attendee.

6. Event Listings and Content

You agree that all content you submit:

• is lawful and does not infringe copyright
• you have permission to use the images, logos, and text provided
• is not fraudulent, offensive, or illegal

MYHitch Pass may remove, suspend, or edit any event listing that violates policies, poses safety concerns, or contains inappropriate or misleading content.

7. Fees and Charges

Platform fees, processing fees, and service fees apply to all paid tickets.

Fees are displayed in your organiser dashboard and may be updated or adjusted with notice.

8. Marketing and Promotion

By listing an event, you grant MYHitch Pass a non-exclusive licence to use your event content for:

• platform listings
• advertising
• social media promotions
• email marketing
• SEO and discovery enhancements

This licence is used only to promote your event and improve platform visibility.

9. Limitation of Liability

To the fullest extent permitted by Australian law:

• MYHitch Pass is not liable for event cancellations, injuries, financial losses, or operational issues.
• MYHitch Pass is not responsible for organiser actions, omissions, or event management.

You agree to indemnify MYHitch Australia for claims arising from your event, ticket sales, safety, advertising, or interactions with attendees.

10. Privacy and Data Handling

Organisers must comply with:

• the Privacy Act 1988 (Cth)
• the MYHitch Pass Privacy Policy
• all data protection obligations

Attendee information may only be used for event-related communication. It may not be sold, shared publicly, or used for unrelated marketing purposes.

11. Account Suspension or Termination

Your organiser account may be suspended or terminated for:

• misleading or unsafe events
• unlawful activity
• excessive complaints or disputes
• failure to comply with these Terms

Pending payments may be held during investigations or until issues are resolved.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes must be resolved in the courts of NSW.

13. Acceptance of Terms

By submitting or editing an event, you confirm that:

• you accept these Terms & Conditions
• you are authorised to act on behalf of the event or organisation
• you understand that MYHitch Pass is a digital platform only
• you accept full responsibility for your event and ticketing obligations
